General information

  1. LSP.expert exists for its users. We want to provide all users with a high quality service and to that end we reserve the rights stated in these Terms of Service.
  2. These Terms of Service define the conditions of use of the www.lsp.expert website, ("Website"). This Website is operated by CoScale IT sprl ("LSP.expert" or the "Service provider"), Rue Raymond Hernalsteen, 61, 1970 Wezembeek-Oppem, Belgium (VAT no.: BE0563.976.806).
  3. By accessing LSP.expert or any of the associated products or services (the "Service"), you are agreeing to be bound by the following terms and conditions ("Terms of Service") and all applicable (local) laws and regulations.
  4. LSP.expert may revise these Terms of Service and any associated document at any time without notice. You will only be informed of such revisions through these Terms of Service. We therefore recommend that you check these Terms of Service regularly in order to be informed of any changes. By using the Service you are agreeing to be bound by the current version of these Terms of Service. You - cannot use the Service if you do not agree with these Terms of Service.
  5. Any violation of the Terms of Service below will result in the termination of your Account or your access to the Service.

Purpose of the Service

  1. The Service and information available on the LSP.expert Website are provided "as is" and "as available". They are provided merely for informational purposes. Under no circumstances do they constitute advice of any kind and they cannot replace personal judgement.
  2. LSP.expert makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Furthermore, LSP.expert does not warrant or make any representations concerning the accuracy, results, or reliability of the use of the Service or information on the LSP.expert Website.

Links to third party websites

  1. LSP.expert may provide links to third party websites which are not under its control. Such links are provided for information purposes only. If you decide to click on any of these links, you do so at your own risk. The fact that LSP.expert provides a link to a third party website does not imply that LSP.expert approves, authorizes or finances these sites, or that LSP.expert has any link with these third parties.
  2. In addition, third party sites may provide links to the LSP.expert Website. In general, such links can only be included with the prior consent of LSP.expert. However, even where included links have been approved, LSP.expert is not able to verify all the content of the sites concerned and therefore gives no guarantee with regard to these sites.

Characteristics of accounts created on LSP.expert

  1. Accounts created by computer robots ("bots") will not be accepted and will be deleted.
  2. You must provide your full name, a valid email address and any other information deemed necessary by LSP.expert in connection with the creation of your account or its use.
  3. You are responsible for the privacy of your account and your account login information. Make sure you choose a secure password and do not reveal it to anyone.
  4. You are responsible for all data encoded in connection with the use of your account.

Cancellation and termination

  1. You can cancel your account at any time.
  2. LSP.expert, at its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other LSP.expert service, for any reason at any time. In case of termination all content associated with the account will be deleted. Nevertheless, LSP.expert shall keep records of the account information, for its own use and for administration purposes only.
  3. In particular, LSP.expert reserves the right to suspend or terminate your account if your account's bandwidth usage or server resource consumption significantly exceeds the average bandwidth usage or server resource consumption as determined solely by LSP.expert.

Modifications to the Service

  1. LSP.expert reserves the right at any time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
  2. LSP.expert may review and change prices and service plans at any time if needed. You will be notified of such changes by email.
  3. LSP.expert shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

Payments and refunds policy

  1. LSP.expert only accepts payments through credit card (VISA, MasterCard and AMEX).
  2. You won't be charged during the 30-day free trial.
  3. If you do subscribe, you will be notified by email each time a payment is due. If after 6 days we have not received your payment, your account will be suspended and you won't be able to access LSP.expert until your payment has been made.
  4. LSP.expert is a month-to-month, pay-as-you-go service. Any refunds are given at the discretion of LSP.expert.
  5. By using the Service you agree to receive all receipts, invoices and other billing documents by electronic means only. Unless otherwise agreed, no paper invoices will be sent.

Service Level, availability and support

  1. LSP.expert aims to maintain a Service availability of at least 99.5%.
  2. LSP.expert will perform periodic service updates, without prior notice, but these should not affect Service accessibility for more than 10 minutes.
  3. LSP.expert may in no way be held liable for any Service outages or access problems.
  4. In the event of a Service outage, LSP.expert will try to restore the Service in the shortest time possible.
  5. LSP.expert aims to provide a very high level of customer support. Most requests will be answered within one working day. LSP.expert reserves the right to answer after a longer period or not to answer some of the support requests, especially if they have been classified as spam either by an automatic spam filter or a human.

Liability

  1. LSP.expert is bound by an obligation of means. LSP.expert shall under no circumstances be held liable for any direct or indirect damages which you incur while using the Website, associated sites and/or the content made available to you.
  2. LSP.expert does its upmost to ensure that the data, documents and information on our Website are complete, up-to-date and accurate. Errors and/or omissions and/or obsolete data cannot be fully excluded. Consequently, LSP.expert gives no guarantee in this respect.
  3. Neither does LSP.expert guarantee an interruption-free Service. LSP.expert makes every effort to ensure that the Website remains accessible, at all times, to a normal number of users. However, under no circumstances shall LSP.expert be held liable for any direct or indirect damage linked to a modification, suspension or interruption of access to the Website, for any reason whatsoever.
  4. In no event shall LSP.expert be liable for contact and relationships between users of the Website. LSP.expert cannot be held liable in any way for any damage resulting from messages from third parties, nor for any possible errors in their content. All texts, data, messages or other material placed in these messages are the exclusive responsibility of the person who posted them.
  5. Except in case of wilful misconduct, LSP.expert or its suppliers can in no event be liable for:
    • damages arising out of Service technical difficulties, including due to viruses (see in particular point 2 of "Miscellaneous provisions"), system interruption, links to third party sites or third party sites linking to the site;
    • damage caused to your IT infrastructure and any loss of data arising out of downloading data through the Service;
    • damage resulting from interactive applications;
    • loss of profit, opportunity or income, or interruption to business arising out of the use or inability to use the Service, even if LSP.expert or its authorized representative has been notified orally or in writing of the possibility of such damage;
    • damage resulting from the use of the Service, which is caused by acts or by third parties which are not under LSP.expert's control;
    • damage resulting from material errors in the information and data provided through the Service or originating from third parties;
    • damage resulting from your improper use of the Service;
    • damage resulting from your own use of the data and information provided through the Service.
  6. Moreover, the user acknowledges and accepts:
    • The restrictions and risks associated with use of the Internet or of any other means through which the Website is made available, now or in the future;
    • The risks involved in storing and transmitting information electronically or digitally;
    • The fact that LSP.expert cannot be held liable for any damage caused by use of the Website (as well as all or a part of its content) or the Internet following risks outside of its control;
    • The fact that the electronic communications exchanged and the back-ups performed by LSP.expert can be used as evidence.
  7. Any advertisements included on the Website are always the responsibility of third parties. Under no circumstances can LSP.expert be held liable for the legality, accuracy, supply, content, effective operation and/or the quality of the goods and/or services offered as part of these advertisements.

Copyright and content ownership

  1. You acknowledge that the Service contains information, software, pictures, lay-out, texts, graphics, source code, ideas and other documents, which are protected by copyrights, database rights, trademark rights and/or other intellectual property rights, and that these rights are valid and apply to the current shapes, media and technologies, as well as to those that could be developed in the future. LSP.expert is the proprietor or licensee of all these rights and all content available on LSP.expert is protected by the applicable law.
  2. By browsing, viewing, subscribing to, downloading files from or using the content of the Website, in any way whatsoever, in no event do you become the holder of any of the rights specified above or any related rights.
  3. You may not duplicate, copy, or reuse any portion of the design, HTML/CSS, Javascript or any other code created by LSP.expert without express written permission from LSP.expert.
  4. You are not allowed to reverse engineer or access the Service in order to (i) build a competitive product or service, (ii) build a product using similar ideas, features or functions of the Service, or (iii) copy any ideas, features or functions of the Service.
  5. All content posted on the Service must comply with copyright law.
  6. By placing data, texts, images and/or any other item online, you automatically and freely grant LSP.expert exclusive authorization to reproduce these items, to disseminate and/or to use them in another way, both on the Website and in one or more magazines or products published by LSP.expert.
  7. LSP.expert guarantees that the items on the Website and made available to you solely by LSP.expert comply with the rights of third parties, and more generally are not illicit.

Data protection

LSP.expert has a Privacy Charter which covers all of its obligations and information with regard to personal data. This Charter is available on the LSP.expert Website.

Miscellaneous provisions

Force majeure

LSP.expert cannot be held liable, contractually or extracontractually, for any temporary or permanent non-fulfilment of its obligations where this non-fulfilment results from a case of force majeure or an act of God.

The following events will be considered as cases of force majeure or acts of God: (1) total or partial loss or destruction of LSP.expert's computer system or its database when any of these events cannot reasonably be attributed directly to it and that it has not been shown that LSP.expert has failed to take reasonable measures to prevent one or other of these events; (2) earthquakes; (3) fires; (4) floods; (5) epidemics; (6) acts of war or terrorism; (7) strikes, whether declared or not; (8) lock-outs; (9) blockades; (10) insurrections and riots; (11) an energy supply stop (for example, electricity); (12) a failure of the Internet or data storage system; (13) a failure of the telecommunications network; (14) a loss of connectivity to the Internet or telecommunications network on which LSP.expert depends; (15) an act or decision of a third party where that decision affects the proper performance of this contract; or (16) any other cause beyond the reasonable control of LSP.expert.

Viruses, bugs and other malware

All data entered on the Website is checked to ensure it does not contain any known viruses. Nevertheless, LSP.expert cannot guarantee the total absence of viruses, owing to the risk inherent in using the Internet.

You agree to take all reasonable and necessary precautions to prevent your equipment or data from being infected with viruses, bugs, Trojan horses, spyware or any other malicious computer program of any kind.

You are therefore strongly advised to install firewalls, antivirus and other necessary protection software to prevent possible damage to your computer, and to be cautious about the communication of personal data.

Severability

Any illegal, null and void or unenforceable article, paragraph or provision (or part of an article, a paragraph or a provision) does not in any way affect the legality and the applicability of the other articles, paragraphs or provisions of these Terms of Service, or the remainder of this article, paragraph or provision, unless otherwise clearly intended in the text.

If any part of these Terms of Service is considered to be completely or partially invalid, LSP.expert will replace it with a provision with equivalent economic effect that will be as close as possible to the economic effect of the provision declared invalid.

Disputes

Any disputes relating to the services provided by LSP.expert or concerning the validity, interpretation or execution of these Terms of Service shall be subject to Belgian law and shall fall under the exclusive jurisdiction of the French-speaking courts of the judicial district of Brussels.
